BEKSAV members acquitted in trial over banned Pride Month film screening

Members of the Science, Aesthetics, Culture, and Art Research Foundation (BEKSAV) were acquitted in a trial stemming from their attempt to hold a film screening during 2023 Pride Month. The screening, which had been banned by the Kadıköy District Governor’s Office, led to the detention of eight individuals. The Istanbul Anatolian 45th Criminal Court of First Instance ruled that the alleged offense was not proven beyond reasonable doubt.


Details of the case

The trial concerned charges of "violating the Law on Meetings and Demonstrations No. 2911." The fifth hearing took place without the presence of the defendants, but their lawyer, Doğukan Taşdan, was in attendance.

In the prosecutor's closing opinion, it was stated that the evidence presented did not conclusively prove the allegations. The prosecutor requested acquittal, and the court ruled accordingly, stating that the alleged offense had not been established.


Background: The film screening ban and detentions

BEKSAV’s Cinema Collective had planned to screen the film Pride—which portrays solidarity between LGBTQ+ activists and Welsh miners—on June 7, 2023, as part of Pride Month events. Following the ban issued by the Kadıköy District Governor’s Office, BEKSAV publicly declared its intention to proceed with the event and invited the public to the screening.

Before the screening could take place, police surrounded BEKSAV’s building and blocked access. Artists attempting to engage with authorities were held in the blockade for hours and later detained under alleged mistreatment. Roads leading to the venue were barricaded, and individuals showing solidarity were reportedly assaulted by police.

The BEKSAV members were eventually released in the early hours of the next morning, miles away from the organization’s headquarters.


Significance of the ruling

The acquittal marks a significant decision in favor of freedom of expression and assembly, particularly in the context of events supporting LGBTQ+ rights in Turkey. Pride Month activities in Turkey have faced increasing restrictions in recent years, with bans and police interventions becoming more frequent. The ruling underscores the importance of upholding legal standards in cases involving public demonstrations and cultural events.
