İstanbul — The second hearing of the case filed against singer Fatih Karaca, known as Mabel Matiz, on charges of “obscenity” due to the lyrics of the song “Perperişan,” was held at the Istanbul 54th Criminal Court of First Instance. Karaca did not attend the hearing; his lawyers were present in the courtroom.
The court stated that in the report prepared by the Board for the Protection of Minors from Harmful Publications, there was an evaluation that “the best interests of children are harmed.” It was also expressed that the report emphasized that Karaca is an artist and therefore the final assessment belongs to the court.
Speaking at the hearing, the lawyer of the Ministry of Family and Social Services requested that the defendant be punished, stating that the report indicated the song violated children’s interests.
In his defense statement, Karaca’s lawyer said that the issue to be discussed is whether obscenity is constituted within the scope of the Turkish Penal Code. He stated that the report expressed that the best interests of children were harmed, but that this alone does not mean obscenity. He said there is no pornographic element in the song and that for obscenity, pornographic content must be sought.
The prosecutor requested that the Ministry of Family and Social Services’ request to intervene be accepted. The court accepted this request.
It was stated that since the prosecutor of the hearing is on one-week leave, the opinion on the merits cannot be presented. The court decided that the file be sent to the prosecution office between sessions and that the opinion be prepared.
The hearing was postponed to April 30 at 9:30 a.m.
About the case
In the indictment, it was claimed that the expressions in the lyrics of the song “Perperişan” contain sexual connotations, include erotic descriptions, and may be harmful for children. For this reason, a prison sentence from 6 months to 3 years was requested for Karaca on the charge of “mediating the publication of obscene publications.”
In a previous hearing in the case, the court asked Karaca to whom the song was written. Karaca stated that he found this question “sad and hurtful” and responded, “Anyone can sing for anyone.”
